Arizona Residential Landlord-Tenant Law

APPLICABILITY OF THE ACT

The Act, A.R.S. §§ 33-1301 to 33-1381, applies if you are renting a residential dwelling unit, such as a house or an apartment.

If you rent a mobile home, you are covered by the Arizona Mobile Home Parks Residential Landlord and Tenant Act, A.R.S. §§ 33-1401 to 33-1491.

The other major set of Landlord and Tenant statutes, A.R.S. §§ 33-301 to 33-381, is designed primarily for commercial or real property landlord-tenant relationships.

EXCEPTIONS TO THE ACT

Besides the types of leases mentioned above, A.R.S. § 33-1308 lists seven exceptions.

  1. Residence at an institution, if incidental to detention, such as a hospital, dormitory, or for counseling or religious services, or residence due to participation in a social service program 

  2. Occupancy under a contract of sale of a residential unit or property if the occupant is the purchaser

  3. Residence at a fraternal or social order residence (e.g. a fraternity house).

  4. Temporary residence at a hotel, motel or recreational lodging.

  5. Occupancy by an employee of a landlord as a manager or custodian whose right to reside on the property is conditional upon his or her employment.

  6. Occupancy by an owner of a condominium unit or a holder of a proprietary lease in a cooperative.

  7. Public housing residences, established pursuant to federal law
